Design registration in India provides legal protection for the unique appearance, shape, configuration, pattern, ornamentation, or composition of lines or colors applied to an article. The Designs Act, 2000 governs design registration, ensuring that original and aesthetic designs used in industrial processes or mass production are safeguarded against unauthorized copying.
A registered design provides an exclusive right to the owner for a period of 10 years, which can be extended for another 5 years upon renewal.
Under the Designs Act, 2000, the following types of designs can be registered:
1. Industrial Designs – Applied to products manufactured on a large scale, such as vehicles, furniture, and packaging materials.
2. Textile and Apparel Designs – Patterns or motifs applied to clothing, fabrics, and accessories.
3. Consumer Goods Designs – Household items, electronics, kitchenware, and cosmetics packaging.
4. Medical and Scientific Equipment Designs – Shapes and appearances of instruments, devices, and containers used in healthcare.
5. Automobile and Machinery Designs – External features of vehicles, tools, or industrial machines.
To qualify for registration, a design must meet the following criteria:
• Originality and Novelty – The design must be unique and not previously published or disclosed in India or any other country.
• Distinctiveness – It should not be a mere mechanical or functional feature but rather an aesthetic improvement to a product.
• Applicability to an Article – The design must be applied to an article that is produced by an industrial process.
• Non-Offensive and Non-Scandalous – The design should not include obscene or objectionable material.
• Not a Trademarks or Artistic Work – Designs that function as trademarks or are covered under copyright law are not eligible.
• Legal Protection – The registered owner gets exclusive rights to use the design for commercial purposes.
• Prevents Unauthorized Copying – Design registration helps in restricting competitors from copying or imitating the design.

1. Preparation of Application – The applicant must complete Form 1 with all required details and representations of the design.
2. Filing of Application – The application is submitted to the Office of the Controller General of Patents, Designs & Trademarks.
3. Examination of the Application – The Design Office examines the application for novelty, originality, and compliance with legal requirements.
4. Objections & Response – If objections are raised, the applicant must respond with necessary clarifications or modifications.
5. Publication in the Official Gazette – Once accepted, the design is published in the official journal for public knowledge.
6. Issuance of Registration Certificate – If no opposition is raised within the stipulated time, the Design Registration Certificate is issued.
